Getting Married in South Africa: The Legal Side, Explained

Somewhere between choosing flowers and finalising the seating chart, there's a far less glamorous — but far more important — part of getting married: making it legal. Here's a plain-language overview of what that actually involves in South Africa.

The Basics Every Couple Should Know

👤 You need a registered marriage officer

In South Africa, only a marriage officer designated by the Department of Home Affairs can legally solemnise your marriage — whether that's a religious leader, a civil marriage officer, or a Home Affairs official. Without one, no ceremony (however beautiful) is legally binding.

📋 Your marriage regime matters — and it's decided before the wedding

South African law recognises a few different marriage regimes (in community of property, out of community of property with accrual, and out of community of property without accrual). Each has real, long-term financial implications, and the choice needs to be made — and formalised where required — before you say "I do," not after.

📝 Ante-nuptial contracts need a notary, in advance

If you're not marrying in community of property, that generally needs to be formalised through an ante-nuptial contract (ANC), signed in front of a notary before the wedding day. This isn't something that can be sorted out afterwards.

🪪 Documentation is non-negotiable

Both parties need valid identification, and if either of you has been married before, a divorce order or death certificate is typically required. If one of you is a foreign national marrying a South African, you'll also need valid passports and a completed Home Affairs form declaring there's no legal impediment to the marriage. Requirements can vary, so it's worth confirming exactly what your marriage officer needs well ahead of time.

👥 You need two witnesses

Every legal marriage in South Africa needs at least two witnesses present, each over 18 with valid ID of their own. Most couples pull this from their bridal party without a second thought, but it's still worth confirming who's playing that role on the day.

📅 Book your marriage officer early

Popular marriage officers get booked out well in advance, especially for peak wedding season. Confirming your officer early is as important as booking your venue.

Worth remembering: the legal side of your wedding is separate from the ceremony itself. You can have the most romantic, personalised ceremony imaginable — but it's the paperwork and the registered officer that make it legally official. Once you've signed the register on the day, that's it — you're legally married on the spot.

On the Horizon: A Single Marriage Law

Here's a genuinely useful thing to know: South Africa's marriage laws are set to change. A new Marriage Bill has been introduced in Parliament to combine the current patchwork of separate laws — the Marriage Act, the Recognition of Customary Marriages Act, and the Civil Union Act — into one unified law covering all marriages, regardless of religion, culture or sexual orientation. It hasn't been finalised yet, so today's rules still apply, but it's worth keeping half an eye on if your wedding is still a way off.

This is the short version. Troy Goldie is a Cape Town marriage officer with over 20 years' experience — and, by his own account, the only marriage officer in the world who runs his own YouTube channel, where he vlogs the real weddings he performs around the country alongside videos on the legalities of getting married in South Africa.

Troy describes his role as more than a legal formality. He sees performing the ceremony as a genuine part of a couple's story, taking his lead from what each couple wants rather than imposing a script — less a service provider, in his words, and more a friend along for the day.
